The essay takes into consideration the origins of the legitimacy for subsequent marriage with reference to the Constantinian constitution mentioned in C. 5, 27, 5. Many scholars believe that the disposition of Constantine mentioned by Zeno was preserved in the Theodosian Code and was more precisely placed in C.Th. 4, 6, 1, a text now lost. On the other hand, we want to demonstrate that the Constantinian constitution, due to its transitory nature, was not included in the Theodosian Code, which is why it does not even appear in the Codex repetitae praelectionis.
