The paper deals with the Italian regulatory situation in the Corona virus emergency by proposing a reflection, both on the regulatory choices made by the government and also about the necessary balance of rights that seems to have been set aside in the emergency. Finally, the contribution focuses on the worrying decision by the Italian government to prolong the state of emergency beyond the real needs. It is the Author’s belief, that ignoring the constraints of the source of law system and the relationship between fundamental rights by entrenching behind the emergency, constitutes a danger for the democratic system. The end (even if commendable) does not always justify the means.
