The paper discusses the topic of regional laws that affect the “fundamental functions” of the Municipalities, whose definition is a matter of exclusive competence of the State (art. 117, paragraph 2, letter p, of the Constitution). It reviews the guidelines regarding the constitutional judge and the technique of judgment used to decide questions of constitutional legitimacy regarding regional laws with particular focus on the urban planning function of the Municipalities. The sentence no. 179/2019 of the Constitutional Court relating to the law of Lombardy no. 31/2014 regarding the containment of land use is also examined. The writing positively underscores the use of judgment standards arranged in sequence, but at the same time detects some critical issues present in the sentence.
