Regolazione dell'energia elettrica da fonte rinnovabile in particolare nei terreni agricoli

In this work we intend to emphasize the multifunctional of agriculture, both as production agriculture and as protection agriculture, which often absorbs a whole series of services of public interest. Starting from this figure, we focused on the regulation of renewable energies in the agricultural sector, on the basis of supra-national, community and national regulations. The main theme is the inseparable relationship between agriculture and environmental protection, which has involved, on the one hand, regulation of the standards to be reached by each Member State in the production of the renewable energy, on the other hand, the provision of support measures or State aid for the achievement of the objectives which the European Union has set itself. Finally, the role of the regions in the selection of sites for the allocation of RES was examined, opening this aspect to serious problems of a constitutional nature in view of the provisions of art. 117 of the Italian Constitution.

Nel presente lavoro s’intende porre l’accento sulla multifunzionalità dell’agricoltura, sia come agricoltura di produzione, sia come agricoltura di protezione, che sovente assorbe tutta una serie di prestazioni di servizi di interesse pubblico. Partendo da tale dato ci si è soffermati sulla regolamentazione delle energie rinnovabili nel settore agricolo, sulla base delle normative sovra nazionali, comunitarie e nazionali. Il tema verte prevalentemente sull’inscindibile rapporto che passa tra agricoltura e tutela dell’ambiente: ciò ha implicato, da un lato, una regolamentazione degli standard a cui ciascuno Stato membro deve pervenire nella produzione di energia rinnovabile, dall’altro, la previsione di misure di sostegno ovvero di aiuti di Stato per la realizzazione degli obiettivi che l’Unione europea ha previsto. Infine, è stato preso in esame il ruolo delle regioni nella scelta dei siti per l’allocazione delle FER, aprendo questo aspetto, a gravi problemi di carattere costituzionale in considerazione di quanto previsto dall’art. 117 della Costituzione.
