The contribution examins the secondary agreements between the Church and the political community after the signing of the Villa Madama Agreement of 1984. Some of them – explicitly foreseen in the text of that Agreement – have the carachter of implementing disposals: others are true and proper agreements between the competent ministries of the State and the Italian Episcopal Conference on new matters. This dynamic development was partly contemplated in 1984, and partly not. Above all, it was not possible to foresee the strong development of ecclesiastical law at regional level through sub-agreement of a local nature. This progressiv phenomenon is not typical only of the Italian situation, but it is recorded in this last years also in other European countries. This involves many interpretative problems and implies a new situation of relations between State and Church. In particular, the actually transit is characterized a much more articulated and fragmented system compared to the traditional panorama offered by the sources of ecclesiastical law.
Il contributo prende in considerazione le intese secondarie intervenute tra Chiesa e comunità politica dopo la firma dell’Accordo di Villa Madama del 1984. Alcune di esse – esplicitamente previste nel testo di quell’Accordo – si pongono come provvedimenti attuativi: altre come veri e propri accordi tra ministeri competenti dello Stato e Conferenza episcopale italiana su nuove materie. Questo sviluppo dinamico era in parte contemplato nel 1984, ed in parte no. Soprattutto, non era prevedibile il forte sviluppo successivo del diritto ecclesiastico tramite intese subconcordatarie a carattere regionale. Questo fenomeno non è tipico solo della situazione italiana, ma si registra, in misura non secondaria, anche in altri paesi europei. Ciò comporta molti problemi interpretativi ed implica il transito dei rapporti tra Stato e Chiesa verso un sistema molto più articolato e parcellizzato rispetto al panorama tradizionale offerto dal sistema delle fonti normative. Di qui la necessità di trovare nuove categorie interpretative del diritto ecclesiastico.
