This paper looks at the main issues in the current political, legal and ethical debate related to the qualification of the relationship of the subject with the body and its parties and the right to property on the body and on the latter, in the tension between individual interests and collective interests. The difficulties that this analysis aims to highlight, also through the investigation of the role of gift-giving, are in using the property model as a unique criterion to settle issues that have to deal with human rights, values and ethical principles such as autonomy and social solidarity.

Abstract
