This paper analyses the functioning of the new unpossessory pledge (introduced in Italy by the Law 119/2016) within a bankruptcy procedure. In particular, the paper analyses the only two provisions about bankruptcy of article 1 Law 119/2016 to check how the rules of Bankruptcy Act referred to the ordinary pledge can be reconciled with the new unpossessory pledge, with a focus on the extensive powers granted to the creditor against the debtor in case of default.
