Prospettive attuali del fare pericoloso precedente

The purpose of this contribution is the review of the spaces to be recognized, in our system, to the guarantee position founded by the c.d. do dangerous precedent. This exigency arises from the need to settle the contrast between the orientations of the doctrine (moreover, not very recent consolidation), inclined to deny them any legitimacy, and those of praxis, on the other hand, inclined to recognize them as fully relevant. The mediation between these two poles allows, therefore, to experiment the hermeneutical utility of this figure with respect to the solutions that can be proposed in relation to problems that are always open, such as those connected to crimes aggravated by the event and, more generally, to the negligence in an illicit context

Il contributo esamina le vicende collegate alla posizione di garanzia, rilevante nella prospettiva dell'art. 40, comma 2, c.p., scaturente dal fare pericoloso precedente. Dando atto del contrasto fra dottrina e giurisprudenza in ordine alla sua ammissibilità, il lavoro si prefigge di ritagliarne l'effettivo àmbito applicativo, vagliandone le possibilità d'impiego rispetto alla categoria dei delitti aggravati dall'evento.
