The discussion around the effects of the digital revolution also affects the institutions of Trade Union Law, suggesting in particular to investigate the impact of the technologies on the organization of trade union struggle and onthe traditional relationship between capital and labor. In this context, the essay proposes a focus on netstrike, also known as virtual picket line or cyber picket line. It is a web-based collective actions, implemented both nationally and abroad but still on the margins of the jurists’ reflection. Identified the main elements of this model of digital activism against the employers, the A. illustrates some proposals about the legal classification of the netstrike, deepening the possible adaptation of the jurisprudential concept of strike in the light of recent developments in terms of Trade Union practices.
La discussione attorno agli effetti della rivoluzione digitale coinvolge anche gli istituti del diritto sindacale, inducendo a soffermarsi sull’impatto delle tecnologie applicate alla rete sull’organizzazione della lotta e sul tradizionale rapporto tra capitale e lavoro. In tale contesto, il contributo propone un focus sul netstrike, pure noto come virtual picket line o cyber picket line, praticato sia a livello nazionale che all’estero ma ancora ai margini della riflessione scientifica. Identificati i principali elementi di tale modello di digital activism contro l’impresa, l’A. illustra alcune proposte di inquadramento giuridico del netstrike, soffermandosi in particolare sulla possibilità di adattare la nozione giurisprudenziale di sciopero alle recenti evoluzioni sul versante delle azioni collettive.
