The work focuses on the use of the criterion of historical interpretation in C. Cass., sez. III, 30 October 2018, no. 27442. Through the analysis of the limits to the agreement on the interest in Roman law and in the Roman legal tradition, the Court of Cassation states that the interest on late payments, like the interest for use of money, is subject to the respect of the provisions contained in the anti-usury legislation. The ruling emphasizes, on several occasions, the role played by the criterion of historical interpretation for a better understanding of the law in force.
