In a telematic context like the present, characterized by the interconnection of the global users and the ability to communicate and disseminate ideas, opinions and intellectual works in the digital domain, mainly due to the success achieved by the phenomena of the Web 2.0 sites, such as social networks and user-generated content, has been developed the need to find legal solutions to the regulation of such practices and to predetermine, by contract, the terms of use of the services offered by these websites. The latter, in particular, have contributed greatly to the creation and sharing content online. Regarding this kind of work, the current legislative framework of copyright is still rather flimsy, characterized by excessive rigidity in the face of dynamic phenomenon. For this reason, on the web have been developed practices of regulation of the copyright through agreements between users and rights holders and any platform providers and intermediaries, as the result of genuine mutual concessions. This article aims to analyze the contractual conditions proposed by the new sites and platforms that characterize Web 2.0, relating, in particular, to the intellectual property rights on the published content, to the license granted by users on the contents, to the Software license granted by the web platform, to the responsibility for the content published, to the publication of content subject to third party rights, and to the retention of content, with a specific focus on the their peculiarities and critical aspects.
In un contesto telematico come quello attuale, caratterizzato dall’interconnessione della globalità degli utenti e dalla possibilità di comunicare e diffondere idee, opinioni e opere a livello digitale, grazie soprattutto al successo raggiunto da fenomeni del web 2.0 quali i social networks e i siti user-generated content, si è sviluppata l’esigenza di individuare soluzioni giuridiche di regolamentazione di tali pratiche e di predeterminare, a livello contrattuale, le condizioni di utilizzo dei servizi offerti dai suddetti siti web. Questi ultimi, in particolare, hanno contribuito enormemente alla creazione e condivisione contenuti online. Riguardo a questo genere di opere, l’attuale disciplina del diritto d’autore appare ancora piuttosto deficitaria, caratterizzata da eccessiva rigidità a fronte della dinamicità del fenomeno. Per tale motivo, sul web si sono sviluppate pratiche di delineazione del diritto autorale grazie ad accordi contrattuali tra utenti, titolari dei diritti ed eventuali fornitori di piattaforme e intermediari, frutto di vere e proprie concessioni reciproche. Il presente articolo mira ad analizzare le condizioni contrattuali proposte dai nuovi siti e piattaforme che caratterizzano il web 2.0, relative, in particolare, ai diritti di proprietà intellettuale sui contenuti pubblicati, alla licenza d’uso sui contenuti concessa dall’utente, alla licenza d’uso sul software concessa dalla piattaforma web, alla responsabilità sui contenuti pubblicati, alla pubblicazione di contenuti oggetto di diritti di terzi e alla conservazione dei contenuti, con specifica attenzione sulle peculiarità e gli aspetti critici delle stesse.
