The article sets out by studying the mainstream legal and economic scholarship on ‘commons’ and then focuses, in comparative perspective, on the potential of general contract law and of company law to enhance citizens’ participation and democratic supervision on the management of public-interest goods and services (such as water supply), which are vital to the community. Control on the actual destination of the funds provided to the company by its investors and stockholders must be effective, that is why the author analyzes the place and role of the blockchain technology (and of the so-called cryptocurrencies) to minimize the risk of conflicts of interest while monitoring cash flows.
