Il significato e il valore di una rivista interdisciplinare per il recupero dell'unità della cultura e dell'esperienza giuridica

The contribution considers, at the beginning, the foundation of the Archivio giuridico. The intent of the Review’s founding fathers – Pietro Ellero and Filippo Serafini – was to offer the contribution of legal science to the construction of Italy, that had just reached a his unity. Thus, the Roman law studied by them is no longer simply a historical memory: but becomes a material of juridical construction in the present: and, according to this logic, the Archivio giuridico is born to host the unity of all the juridical disciplines that contribute to building the State. This ethical approach will lead these men to assume direct political responsibilities in the public life of their time. From the beginning, therefore, the Archivio giuridico bears the imprint – as it were genetic – of interdisciplinarity and multidisciplinarity: to which, unique among Italian legal Journals, it has remained coherent. In the present time, time characterized by an exasperated specialization, this vocation proves even more useful, precious and actual, since it is a general belief that scientific-technical progress depends not only on one strong specialization but, today more than yesterday, on the contamination between different disciplines. It is therefore no coincidence that the Archivio giuridico – thanks to the efforts of its Directors – has once again become a class A magazine by the Italian research evaluation system: that is, the maximum satisfaction level and the greatest scientific impact.

Il contributo prende le mosse dalla fondazione dell’Archivio giuridico. L’intento dei padri fondatori della Rivista – Pietro Ellero e Filippo Serafini – era quello di offrire il contributo della scienza giuridica alla costruzione dell’Italia che era appena diventata uno Stato unitario. Così il diritto romano da loro studiato diventa non più memoria storica ma materiale di costruzione giuridica nel presente: e, secondo questa logica, la rivista Archivio giuridico nasce per ospitare l’unità di tutte le discipline giuridiche che concorrono a costruire lo Stato. Tale impostazione etica porterà questi uomini ad assumere anche responsabilità politiche dirette nella vita pubblica del loro tempo. Fin dall’origine, dunque, l’Archivio Giuridico reca l’impronta – per così dire genetica – della interdisciplinarietà e della multidisciplinarietà, alla quale, unica tra le riviste giuridiche italiane, è rimasta fedele. Nel tempo di una specializzazione esasperata questa vocazione si rivela ancora di più utile, preziosa ed attuale, dal momento che è oramai convinzione generale che il progresso tecnico e scientifico dipenda non solo dalla specializzazione ma, oggi più di ieri, dalla contaminazione tra discipline diverse. Non è dunque un caso che l’Archivio giuridico – grazie all’impegno dei suoi Direttori – sia tornato ad essere una Rivista di classe A nel sistema di valutazione della ricerca in Italia: cioè la fascia di gradimento massimo e di maggior impatto scientifico.
