Control judicial de la regulación económica en clave de los actos administrativos proferidos por la Comisión de Regulación de Comunicaciones (CRC)

In the context of the processes of liberalization and new economic regimes at the constitutional level, economic regulation has positioned itself as one of the main activities of State intervention on the economy. Regulation has been perceived as a neutral, independent and technical instrument designed to solve market failures and to harmonize economic and non-economic goals,usually conflicting. The place of judicial control is very questionable, showing clashes between the guarantee of access to justice for the people and the technical expertise of regulators. Then, it is carried out a material analysis of the acts published by the regulatory authorities in terms of the extension of the principle of legality, and based on the functions assigned to the crc according to the Law 1341 of 2009, for the purpose of determining parameters, limits and scopes of the judicial control.
