Contracts Used for the Charter or Lease of Pleasure Vessels in Pleasure Navigation: an Italian Perspective

The article analyzes the legal framework of the contracts of lease and charter of pleasure vessels and the related issues, comparing the regime provided by the Italian Navigation Code in general with the specific regime of the Italian Pleasure Navigation Code. Particular attention is paid to the problems arising from the main standard contracts developed at the domestic and international level and their qualification according to the categories set by the Pleasure Navigation Code in order to identify the relevant regime, along with the new Italian Law on the finance lease, in order to identify which provisions are consistent with the specific sector of pleasure navigation and the related contracts.
