This paper aims to analyze the answer given by the "Dirección General de los Registros y del Notariado" to the appeals formulated regarding the exigibility of a handwritten declaration by the consumers in mortage loans. The criteria from the "DGRN" can be summarised as follows: the handwritten declaration is exigible in any case as long as the requirements of article 6 of Act 1/2013 are given. The aforementioned requirements must be interpreted in an extensive manner in order to protect the consumer. Finally, we try to reflect on the convinience and utility of this rule taking into account the big amount of critics recieved by the Notaries, precisely those who have to supervise its fulfilment.
Las RRDGRN de 27 de octubre y 10 de diciembre de 2015 abogan (de nuevo) por una interpretación extensiva o “pro-consumatore” en relación con la exigibilidad de la expresión manuscrita del artículo 6 de la Ley 1/2013, de 14 de mayo.
