The contribution examines the institute of approach another nearby diocesan or interdiocesan tribunal provided in can. 1673, § 2 of the Code of canon law, modified by the motu proprio Mitis iudex Dominus Iesus of pope Francis. After listing the legal requirements that allow the diocesan bishop to exercise legitimately the facultas accedendi, this work identifies the cases in which the canon can be applied in accordance with the principles and values that guided the processal reform.
