IL RECESSO DEGLI STATI DALL’UNIONE: EFFETTIVA POSSIBILITÀ O PREVISIONE MERAMENTE... ANSIOLITICA?

The work casts insights on the right for Member States of the European Union to dissociate from the Union itself, in the realm of the overall debate concerning the general and theoretical reasoning about its current structure. The main topics endeavor to analyze: 1) the faculty of contracting out of the E.U., as of art. 50 T.E.U.; 2) the combination of peculiarities of the institutional and regulatory framework which lead to deduce that there is a concrete supranational tendency toward federalism; 3) the reflections produced by the current evolutionary outcomes of the institutional European framework on the possibility of the Member States to engage in the process of separation. The essay also examines the compatibility of this assumed right to disjoin from the E.U. with the increasing tendency to devolve towards European institutions more and more pervasive decision-making powers, with the aim of understanding – also in the light of antecedent experiences already pertained to former political orders – to what extent can single States undergo dissociation and how can it be effectively accounted for and truly recognized, rather than becoming a merely abstract hypothesis.

Il contributo intende riflettere sul c.d. “diritto” di dissociarsi dall’Unione, attraverso la sua contestualizzazione nell’ambito delle argomentazioni teorico-generali concernenti la forma dell’U.E. Ne risultano analizzati: 1) la possibilità – ora riconosciuta agli Stati aderenti ex art. 50 T.U.E. – di fuoriuscire dall’Unione; 2) il complesso di elementi istituzionali da cui è lecito desumere la predisposizione dell’U.E. ad evolvere in senso federale; 3) le conseguenze riverberate dall’attuale stadio evolutivo dell’Unione nei confronti del concreto esercizio dell’“opting-out” da parte di un Paese membro. Lo scritto esamina la compatibilità del “diritto” in questione con la tendenziale devoluzione di sempre più pervasivi ambiti decisionali in favore del livello di governo sovranazionale, per comprendere – anche alla luce di pregresse esperienze occorse in ordinamenti similari – entro quali margini lo Stato aderente all’U.E. possa effettivamente dissociarsi da quest’ultima ovvero se tale possibilità – pure formalmente riconosciuta – sia destinata a rimanere sostanzialmente inattuabile e confinata all’astrattezza.
