This short essay examines the constitutionality of certain provisions of the Italian pension legislation, aimed at reducing the amount of pension payable to the longest-living spouse, in case of marriages between elderly partners. It also recalls the different stages of development of the constitutional case law in this field, as well as the past turning points in which this kind of legal limitations were considered to be in conflict with the freedom to marry, and it casts insights on the possible outcomes of the pending constitutional procedure.
