In contemporary society, the information is characterized as “raw material” of new technologies, and as a key element of economic and social processes for the development of markets. The technologies allow a huge increase of information available, they trigger a change in the way we have and create the “knowledge”, making it dynamic and active. This has a direct impact, among other things, on the economic development. In this perspective, the paper will focus on two essential instruments for economic growth itself: open data and big data. First, the document will analyze the open government data, the open data by public authorities. Through the possibility of reuse, they have the ability to generate knowledge, new services and unreleased products, supporting economic growth. Secondly, the paper will focus on the theme of the big data, a phenomenon by complex legal and social implications and an important tool for understanding and predicting market trends. The analysis will examine the characteristics, differences and legal issues related to these instruments and it will explore how open data and big data can be effectively used to promote growth and create a new relationship between governments and markets in the direction of a real Italian open government.

Nella società contemporanea l’informazione si caratterizza come “materia prima” delle nuove tecnologie, ricchezza ed elemento chiave dei processi economici e sociali per lo sviluppo dei mercati. Le tecnologie permettono una crescita enorme delle informazioni disponibili, attivano un cambiamento nel modo di avere e creare la “conoscenza”, rendendola dinamica e attiva, e questo ha un impatto diretto, fra l’altro, sullo sviluppo economico. In questa ottica, il contributo intende approfondire due strumenti essenziali per la stessa crescita economica: gli open data e i big data. In primo luogo saranno analizzati gli open government data, i dati aperti delle pubbliche amministrazioni, che nella possibilità di essere riutilizzati contengono la capacità di generare conoscenza, nuovi servizi e prodotti inediti, permettendo di fornire impulso e sostegno alla crescita economica. In secondo luogo saranno affrontati i big data, fenomeno dalle implicazioni giuridiche e sociali complesse, leva importante nella conoscenza e nella predizione degli andamenti di mercato. L’analisi approfondirà le caratteristiche, le differenze e gli aspetti giuridici legati a questi strumenti ed esaminerà come gli open data e i big data possano essere efficacemente utilizzati per favorire la crescita e generare un nuovo rapporto fra amministrazioni pubbliche e mercati nella direzione di un reale open government italiano.
