La chiusura del giudice amministrativo alla trascrizione dei matrimoni omosessuali "contratti" all'estero e la ricerca nella giurisprudenza costituzionale dei "contenuti" legislativi delle unioni di persone dello stesso sesso

This article gives an account of a recent decision of the State Council in Italy. This ruling declared the transcriptions of same-sex marriages celebrated in another Country illegitimate. In this perspective, interesting are the recent judgment of the European Court of Human Rights, which condemned Italy, and the US Supreme Court ruling that allowed same-sex marriages in the US. However, these decisions can not have any repercussion on the Italian situation. Starting from these observations, the Author tries to analyze the content of the bill which is now being discussed into the Parliament and aims to understand how the law now in discussion could be modified by the Constitutional Court.
