Il Pontificio Consiglio per i Testi Legislativi nell'assetto istituzionale della Curia Romana tra diritto vigente e prospettive di riforma

The Pontifical Council for Legislative Texts in the institutional framework of the Roman Curia between existing law and prospects of reform The reforms of the Roman Curia that followed the Second Vatican Council have established the institution of a new category of Dicasteries that help the Roman Pontiff in governing of the universal Church, that is, the Pontifical Councils. They are characterized to exercise functions mainly promotional, using only marginally the potestas regiminis. This contribution shows that there is an ‘anomaly’ between the Pontifical Councils, represented by the Pontifical Council for Legislative Texts. In fact, it is a Dicastery which exercises especially the functions of government, partially described in articles 154-158 of the apostolic constitution Pastor Bonus promulgated by Pope John Paul II on 28 June 1988. In light of the reform process of such constitution initiated by Pope Francis, the present work offers to place the Council in the category of the Offices of the Roman Curia and drafts the rules that would illustrate the competences of the new Officium (or Secreteria) pro Legum Textibus. // Le riforme della Curia Romana successive al Concilio Vaticano II hanno segnato la creazione di una nuova categoria di Dicasteri che coadiuvano il Romano Pontefice nel governo della Chiesa universale, cioè i Pontifici Consigli. Essi si caratterizzano per l'esercizio di funzioni soprattutto promozionali, usufruendo solo marginalmente della potestas regiminis. Il contributo mostra come sussista una "anomalia" tra i Pontifici Consigli, rappresentata dal Pontificio Consiglio per i Testi Legislativi. Infatti, esso è un Dicastero che esercita soprattutto funzioni di governo, parzialmente descritte negli artt. 154-158 della costituzione apostolica Pastor Bonus promulgata da Papa Giovanni Paolo II il 28 giugno 1988. Alla luce del recente processo riformatore di tale costituzione iniziato da Papa Francesco, il presente lavoro propone di collocare il Consiglio nella categoria degli Uffici della Curia Romana e "abbozza" le norme che potrebbero illustrare le competenze del nuovo Officium (o Secreteria) pro Legum Textibus.
