Drawing inspiration from an Editorial which appeared just over five years ago in the European Constitutional Law Review, and building upon a more recent contribution by von Bogdandy and Schill, this paper seeks to establish how the Court of Justice of the European Union (CJEU or ECJ) managed the disruptive potential of Art. 4(2) TEU in the post-Lisbon era.
