Anybody has argued, considered the rumors about the conclave of 2013 (that is a secret electoral assembly, as all people knows) that the election of Pope Francis of the 13 March 2013 would be null. During the fifth ballot, in fact, they would have found one ballot-paper in more than the total number of present cardinals. The vote would therefore been canceled, by proceeding immediately to the next voting: the one in which Jorge Mario Bergoglio would have received the required majority for the election. Someone sustains that this decision would be a wrong interpretation of one provision of the Apostolic Constitution universi dominici gregis. Consequently the election of Pope Bergoglio would be affected by irreparable nullity. The contribution explains, based on an illustration of the main provisions of the Constitution of John-Paul II, that even if the facts were gone so as hypothesized, the procedure followed was perfectly ad normam iuris. There is no doubt possible, therefore, about the legitimacy of Pope Francis.

Sulla base di alcune indiscrezioni in merito allo svolgimento del conclave del 2013 - come noto circondato dal segreto - taluno ha sostenuto che l’elezione di Papa Francesco avvenuta il 13 marzo 2013 sia nulla. Durante il quinto scrutinio, infatti, nella fase del conteggio, si sarebbe rinvenuta una scheda in più rispetto al numero dei cardinali votanti. La votazione sarebbe dunque stata annullata, procedendosi immediatamente ad una successiva: quella nella quale Jorge Mario Bergoglio avrebbe ottenuto la maggioranza richiesta per l’elezione a pontefice. Secondo taluno, agendo in tal modo si sarebbe applicata una disposizione della Costituzione Apostolica Universi dominici gregis errata e tale violazione della normativa comporta l’invalidità insanabile dell’avvenuta elezione. Il contributo dimostra, sulla base di un’illustrazione delle principali prescrizioni della Costituzione giovanneo-paolina del 1996, che anche se i fatti si fossero svolti come ipotizzato, la procedura seguita sarebbe stata perfettamente ad normam iuris.
