The variations of the Cultural and Environmental Heritage’s Code due to d.lgs. 62/2008, caused the almost complete re-writing of sponsorship contract, increasing its pertinence in both the subjective and objective points of view. These variations, together with recent subscription of sponsorship contract to reorganize Colosseum, between Ministry of Cultural Heritage and Tod’s s.p.a., are a good idea to analyze the main subjects of sponsorship. This paper was to outline the sponsorship subject within Cultural Heritage, looking at the possible chances as public-private partnership instruments, as explained in art. 118, comma 4, of Constitution, or as tool to obtain the preservation and the valorization of the Cultural Heritage, as established by art. 9 of Constitution.
Lo scritto - prendendo spunto dalla convenzione sottoscritta a Roma tra il Ministero e una società privata avente ad oggetto la ristrutturazione del Colosseo - cerca di delineare il fenomeno della sponsorizzazione nel settore dei beni culturali, individuando le ricadute positive sia in termini di accordi tra proprietario pubblico e sponsor privato, in attuazione dell’art. 118, comma 4, della Costituzione, sia quale strumento per garantire la realizzazione della tutela e della valorizzazione del patrimonio culturale, così come imposto dall’art. 9 della Costituzione.
