The contribution deals with the regulatory interventions of the Italian legislator about the SIEG following the referendum result and the Constitutional sentence, intertwining the subsequent domestic legislation with the EU regulation. The focus of the treatise states the observance of the principle of competition as well as the procedure related to the local Body decisions so that to justify the selected management system. It is underlined the need of an ongoing adjustment of the public service delivery to the market’s and community’s necessity, thus proceeding from a bureaucratic model and from the myth of efficiency to a functional pattern.
