Il digiuno e l'astinenza nel diritto canonico

Il saggio descrive l’evoluzione storica della normativa canonica sul digiuno penitenziale o eucaristico e sulla astinenza dalla carne: dalle prescrizioni delle collezioni pseudo-apostoliche dei primi secoli agli assai abbondanti ed esigenti precetti medievali, all’opera di uniformazione ed omogeneizzazione normativa compiuta dalle autorità ecclesiastiche. Si analizzano poi nel dettaglio i canoni dedicati alla materia nel vigente Codex Iuris Canonici per la Chiesa latina, in comparazione con quelli contenuti nel Codice dei Canoni delle Chiese Orientali. Di notevole interesse, inoltre, la rassegna critica delle disposizioni assunte nel mondo dalle varie Conferenze Episcopali alle quali il Codice stesso attribuisce la facoltà di precisare il diritto comune. The paper describes, on the one hand, the historical evolution of canonical regulations regarding Eucharistic fast and penitential fast, and, on the other hand, abstinence from meat. This historical reconstruction starts from the contents of the pseudo-apostolic collections of the first centuries, then it describes the very numerous and demanding medieval precepts, and considers, in the end, the regulatory work of standardization and homogenization accomplished by ecclesiastical legislation. The paper then analyzes in detail the canons dedicated to the matter in the Code of Canon Law in force for the Latin Church in comparison with those contained in the Code of Canons of the Eastern Churches. Also of great interest is the critical review of the provisions adopted in the world by the various Episcopal Conferences. In fact, the Code confers to the Episcopal Conferences the power to moderate the provisions of universal law.
