In this article, Elisa Baroncini delves into the recent WTO AB ruling on the China – Raw Materials case with specific reference to the applicability of Article XX GATT to Paragraph 11.3 of China’s Accession Protocol. She proposes a different construction of the relation between the two pieces of WTO legislation, deeming such interpretative outcome more in harmony with the object and purpose of the WTO system, in particular with the principle of sustainable development.
