The paper examines the principle of the stability of civil judgments in relation to the new provision of the reopening of the proceeding governed by article 391-quater of the italian code of civil procedure. The a. reflects on the role of the principle of res judicata when the rights to be protected are fundamental rights safeguarded by the european convention on human rights.
