In judicial proceedings concerning parental separation, understood as encompassing all forms of dissolution and/or modification of parents’ relationship, the judicial authority is called upon to resolve disputes characterized by varying degrees of conflict. When child custody represents the core of the dispute, the judge must issue decisions oriented toward the best interests of the child, also through the evaluative tools and transformative interventions provided by Title IV-bis of Book II of the Italian Code of Civil Procedure, introduced by Legislative Decree no. 149/2022 (the so-called Cartabia reform of civil procedure). This contribution examines the content of articles 473-bis.25 et seq. of the Code, with specific attention to article 473-bis.27 concerning the involvement of social and health services, integrating this analysis with the main findings of the scientific literature. The aim is to foster a critical reflection on the psychological competences and professional configurations most suitable for responding to the legislator’s expectations regarding the assessment of family dynamics and the support of processes of parental and relational change.
Nei procedimenti di separazione, intesi come comprensivi di tutte le forme di cessazione e/o modifica della relazione di coppia tra genitori, l’autorità giudiziaria è chiamata a dirimere controversie che presentano livelli variabili di conflittualità. Quando l’affidamento e la cura dei figli costituisce il fulcro del contendere, il giudice deve adottare provvedimenti orientati al superiore interesse del minore, anche attraverso gli strumenti valutativi e gli interventi trasformativi previsti dal Titolo IV-bis del II libro del Codice di procedura civile, introdotto dal d.lgs. 149/2022 (c.d. riforma Cartabia del processo civile). Il presente contributo esamina il contenuto degli artt. 473-bis.25 e ss. c.p.c. con specifico riferimento all’art. 473-bis.27, relativo all’intervento dei servizi sociali e sanitari, integrando tale analisi con le principali evidenze della letteratura scientifica. L’obiettivo è avviare una riflessione critica sulle competenze psicologiche e sugli assetti professionali più idonei a rispondere alle indicazioni del legislatore in materia di valutazione delle dinamiche familiari e di sostegno ai processi di cambiamento genitoriale e relazionale.
