The paper examines the evolution of the functions performed by Italian Chambers of Commerce within the administrative system, with particular attention to the transformations that have emerged in the aftermath of the NRRP. Starting from Law No. 580/1993, the analysis highlights the distinctive legal status of Chambers of Commerce as functionally autonomous public bodies operating at the intersection of economic representation, market regulation and territorial development. The reform introduced by Legislative Decree No. 219/2016 significantly reshaped both the organisational structure and the institutional mission of the chamber system, combining rationalisation measures with substantial critical issues. Within the framework established by the NRRP, Chambers of Commerce have acquired an increasingly important role in digitalisation, innovation and administrative simplification. The Business Register and interoperability tools have become essential infrastructures for legal certainty, data circulation and the reduction of administrative burdens. At the same time, Digital Enterprise Points strengthen the role of Chambers in supporting SMEs throughout the digital and ecological transitions. The analysis of constitutional and administrative case law nevertheless reveals persistent tensions in the relationship between the State, the Regions and functional autonomies. Further challenges concern the balance between the expansion of institutional functions and available resources, as well as between system-wide uniformity and territorial differentiation. The paper therefore identifies a possible evolution towards increasingly specialised, data-driven Chambers of Commerce operating as key actors in multilevel governance. From this perspective, the chamber system increasingly emerges as a strategic administrative infrastructure for competitiveness and for the integration of public administration and the productive sector.
Il contributo ricostruisce l’evoluzione delle funzioni delle Camere di commercio nell’ordinamento amministrativo italiano, con particolare attenzione alle trasformazioni intervenute dopo il PNRR. Muovendo dalla legge n. 580/1993, l’analisi evidenzia la peculiare configurazione degli enti camerali quali autonomie funzionali, poste al crocevia tra rappresentanza degli interessi economici, regolazione del mercato e promozione dello sviluppo territoriale. La riforma attuata con il d.lgs. n. 219/2016 ha inciso profondamente sull’assetto organizzativo e sulla missione istituzionale del sistema camerale, introducendo significativi elementi di razionalizzazione, ma anche rilevanti criticità. Nel nuovo quadro delineato dal PNRR, le Camere di commercio assumono un ruolo crescente nei processi di digitalizzazione, innovazione e semplificazione amministrativa. Il Registro delle imprese e gli strumenti di interoperabilità si configurano come infrastrutture essenziali per la certezza giuridica, la circolazione dei dati e la riduzione degli oneri amministrativi. Parallelamente, i Punti Impresa Digitale rafforzano la funzione di accompagnamento delle PMI nelle transizioni digitale ed ecologica. L’esame della giurisprudenza costituzionale e amministrativa mostra, tuttavia, il permanere di tensioni nel rapporto tra Stato, Regioni e autonomie funzionali. Persistono inoltre criticità connesse all’equilibrio tra ampliamento delle funzioni e disponibilità delle risorse, nonché tra uniformità del sistema e differenziazione territoriale. Il contributo prospetta, pertanto, una progressiva specializzazione delle Camere di commercio quali amministrazioni data-driven e snodi della governance multilivello. In tale prospettiva, il sistema camerale tende a configurarsi come infrastruttura amministrativa strategica per la competitività e per l’integrazione tra pubblica amministrazione e sistema produttivo.
