This article explores the relationship between the principle of solidarity and the right to care, building on the recognition of the latter as an autonomous human right in Advisory Opinion OC-31/25 of the Inter-American Court of Human Rights. Against the backdrop of social constitutionalism, the nuevo constitucionalismo latinoamericano, and evolving Inter-American jurisprudence, it argues that OC-31/25 determines a qualitative shift in the understanding of solidarity: from its traditional role as a structural principle of the social rule of law to a directly applicable normative standard capable of grounding enforceable rights and concrete state obligations in the field of care.

Abstract
