The essay aims at analysing gender dysphoria as an updated declination of personal identity, with a significat impact on health protection of transgender and transsexual people. The topic is analysed in the light of the Court of Justice and ECtHR’s case-law. The jurisprudence on the subject of gender identity is, in fact, relevant, as a “vehicle” and “result” of the changing cultural, social and scientific context in the matter. The Court of Justice’s case-law has mainly focused on the issue of the extension of European legislation on equal treatment and non-discrimination to transgender persons. By converse, the ECtHR’s case-law plays a significant role also with respect to the profile of the legislative framework and administrative procedures provided by States for the legal gender recognition (LGR).
