The essay examines the role of human oversight within the regulatory framework established by Regulation (EU) 2024/1689 on artificial intelligence, with particular regard to high-risk AI systems and its coordination with the Italian national legislation set forth in Law No. 132 of 23 September 2025. The analysis starts from the anthropocentric founda-tion of the AI Act, highlighting how the protection of fundamental rights constitutes the core of the European regulatory model. Within this perspective, human oversight is considered both in its technical meaning under Article 14 AI Act, as a preventive safeguard aimed at minimizing risks to health, safety and fundamental rights, and in its broader systemic dimension, as a general principle of human control over the functioning of high-risk AI systems. The essay ultimately outlines a regulatory model grounded in risk-by-design prevention and on the centrality of human intervention as an essential instrument for ensuring both market trustworthiness and the protection of the European system of fundamental values.
Il saggio analizza la funzione della sorveglianza umana nel sistema delineato dal Regolamento 2024/1689/UE sull’intelligenza artificiale, con particolare attenzione ai sistemi di IA ad alto rischio e al coordinamento con la disciplina nazionale italiana di cui alla legge 23 settembre 2025, n. 132. L’indagine muove dalla matrice antropocentrica dell’AI Act, evidenziando come la tutela dei diritti fondamentali costituisca il fondamento dell’impianto regolatorio europeo. In tale prospettiva, la sorveglianza umana viene esaminata sia nella sua accezione tecnica, disciplinata dall’art. 14 AIA, quale presidio preventivo volto a minimiz-zare i rischi per salute, sicurezza e diritti fondamentali, sia nella sua dimensione sistematica più ampia, quale criterio generale di controllo umano sull’operatività dei sistemi di IA ad alto rischio. Ne emerge un modello regolatorio fondato sulla prevenzione del rischio by design e sulla centralità dell’intervento umano, quale strumento essenziale di affidabilità del mercato e di salvaguardia del sistema valoriale europeo.
