For decades, family law was entirely contained within the civil codes. The Constitution, the Divorce Act, and the Family Law Reform itself marked the beginning of a process of decodification, which has intensified in recent decades. Today, the foundational institutions of family law appear fragmented, and the“new families” exist outside the code, which thus conveys a distorted and partial image of the legal reality of family relationships. The Author considers it desirable to consolidate the entire subject matter, a goal that could be achieved either through a rewriting of the first book of the civil code or, as occurs in other countries, by means of a dedicated Families Code.
