The essay — beginning with a reconstruction of the evolution of both european and domestic regulation concerning energy communities and, more broadly, the promotion of sustainable energy production (from an environmental and social point of view) — examines the role played by contractual instruments in the lifetime of Cers. The a. seeks to underscore that contractual autonomy involves a crucial position not only in the constitutive phase of a Cer, but also in ensuring the availability of facilities, and, lastly, in managing the risks arising from the use of new technologies required for the operativity of Cers.
