Architettura contemporanea e vincolo storico relazionale (nota a Consiglio di Stato, Sez. VI, 14 ottobre 2025, n. 8035)

This article examines and comments on the judgment of the Council of State, Section VI, 14 October 2025, no. 8035, concerning the imposition of a relational historical constraint pursuant to the Italian Code of Cultural Heritage and Landscape (Legislative Decree No. 42 of 2004) on the parking facility known as the “Garage delle Nazioni,” located in Milan. More broadly, the case provides an opportunity to address the issue of the possible protection of works of contemporary architecture under the current legal framework, considering its various dimensions. Finally, the article offers some critical reflections on this subject
