Cognitive and behavioral sciences have become essential components of legal education, fostering the development of new skills grounded in “prob- lem-solving” approaches. Recent research in cognitive science has provided evidence and models of mental functioning that depart significantly from the assumptions traditionally underpinning legal reasoning. The classical view of the individual as a fully rational and self-aware agent, acting with comprehensive and objective knowledge of their environment, is increas- ingly being replaced by an understanding of human behavior as shaped by heuristic shortcuts and ingrained cognitive patterns. At the same time, the integration of neuroscience into the broader field of cognitive scienc- es, along with the rise of increasingly advanced neurotechnologies, urges reflection both on the unprecedented risks these innovations pose to funda- mental rights and on the necessity of developing appropriate mechanisms for their protection.
