La sentenza n. 102/2026 del Consiglio di Stato chiarisce i limiti dell’autonomia regolatoria delle federazioni sportive alla luce dell’art. 102 TFUE. Riformando il T.A.R. Lazio, il Collegio conferma la responsabilità della FIGC per una strategia escludente nel calcio giovanile, fondata su divieti, inerzia convenzionale e indebita estensione dell’“agonismo”. Il giudizio antitrust è autonomo dall’ordinamento sportivo e richiede solo la capacità escludente della condotta, riaffermando la piena sindacabilità delle regole sportive sui mercati rilevanti
