Overturning the Lazio Regional Administrative Court, the Court upheld the Italian Competition Authority’s finding that FIGC pursued an exclusionary strategy in youth football, based on restrictive measures, failure to conclude agreements, and an undue expansion of the notion of “competitive” activity. The antitrust assessment is autonomous from sports law and requires only the conduct’s capacity to exclude competitors, reaffirming the full antitrust scrutiny of sports rules affecting economically relevant markets.

La sentenza n. 102/2026 del Consiglio di Stato chiarisce i limiti dell’autonomia regolatoria delle federazioni sportive alla luce dell’art. 102 TFUE. Riformando il T.A.R. Lazio, il Collegio conferma la responsabilità della FIGC per una strategia escludente nel calcio giovanile, fondata su divieti, inerzia convenzionale e indebita estensione dell’“agonismo”.
