The promotion of scientific research is one of the objectives pursued by European legislation. This article examines the critical issues found in Article 9 of the GDPR and Article 110 of Legislative Decree 196/2003, following the amendments introduced by Law 56/2024, and how the EDPB and the Italian Data Protection Authority facilitate the processing of personal data for research purposes.
La promozione della ricerca scientifica è uno degli obiettivi perseguiti dalla legislazione europea. Il presente articolo esamina le criticità riscontrabili nell’articolo 9 del GDPR e nell’articolo 110 del decreto legislativo 196/2003, alla luce delle modifiche introdotte dalla legge 56/2024, nonché il modo in cui l’EDPB e l’Autorità Garante per la protezione dei dati personali agevolano il trattamento dei dati personali per finalità di ricerca.Esamina l’evoluzione dell’art. 110 del Codice Privacy e il ruolo interpretativo del Garante nel bilanciamento tra semplificazione e garanzie.
