The article examines the institution of the Ombudsman from a comparative public law perspective, focusing on its role as a participatory mechanism and as a tool for the protection of citizens’ rights vis-à-vis public administration. The analysis addresses the transnational diffusion of the Ombudsman and the challenges raised by institutional transplants, highlighting the tension between the abstract model and its practical effectiveness. Within this framework, special attention is devoted to Enrico Campelli’s recent study, which provides a systematic reconstruction of the Ombudsman as a flexible and “migrating” institution, capable of adapting to different legal and cultural contexts, yet exposed to the risk of becoming a merely symbolic device. The article aims to emphasize the value of comparative analysis as a critical method for assessing the effectiveness of the Ombudsman across legal systems and for identifying future developments, particularly in light of the ongoing transformations in the relationship between citizens, administrations and public authorities.
Il contributo analizza l’istituto dell’Ombudsman nella prospettiva del diritto pubblico comparato, muovendo dalla sua qualificazione come strumento di partecipazione e di tutela dei diritti dei cittadini nei confronti dell’amministrazione. L’indagine si concentra sulla diffusione transnazionale dell’istituto e sulle difficoltà che emergono nei processi di trapianto istituzionale, ponendo in evidenza la tensione tra modello astratto ed effettività concreta. In questo quadro, particolare attenzione è dedicata al recente volume di Enrico Campelli, che offre una ricostruzione sistematica dell’Ombudsman come istituto flessibile e “migrante”, capace di adattarsi a contesti giuridici e culturali differenti, ma al tempo stesso esposto al rischio di una riduzione meramente simbolica. Il contributo si propone di valorizzare l’approccio comparatistico quale strumento critico per valutare il funzionamento dell’Ombudsman nei diversi ordinamenti e per individuare possibili sviluppi futuri, anche alla luce delle trasformazioni in atto nel rapporto tra cittadini, amministrazioni e poteri pubblici
