La costituzione delle rappresentanze sindacali in azienda: un percorso lungo e accidentato

The essay examines the issue of establishing company-level trade union representatives, with particular attention to the Constitutional Court’s case law on the matter. It then focuses on the referral order issued by the Modena Court, which led to the recent Judgment No. 156/2025. In this ruling, the Court declared Article 19 of Law No. 300/1970 unconstitutional insofar as it fails to provide for the establishment of company trade union representatives within the comparatively most representative associations at national level. The essay highlights that, however, legislative action remains essential, as expressly emphasized by the Constitutional Court itself.

Il saggio affronta il tema della costituzione delle rappresentanze sindacali aziendali alla luce in particolare della giurisprudenza della Corte costituzionale. Si sofferma, da ultimo, sull’ordinanza di remissione del Tribunale di Modena, che ha condotto alla recente sent. n. 156/2025, con la quale la Corte ha dichiarato l’incostituzionalità dell’art. 19, legge n. 300/1970 nella parte in cui non prevede che le rappresentanze sindacali aziendali possano essere costituite anche nell’ambito delle associazioni comparativamente più rappresentative sul piano nazionale. Sottolinea, comunque, che un intervento legislativo resta fondamentale, come del resto auspicato dalla stessa Corte costituzionale.
