The article aims to examine contractual justice ope iudicis, specifically to investigate the current state of judicial control of contracts from a rebalancing perspective. It starts with the important 2023 supreme Court decision, number 5657, concerning double indexation clauses in leasing contracts. By reviewing some particularly invasive rulings on contractual autonomy, the article focuses on the recent decision of the supreme Court, particularly analyzing the reconstruction of the merit review and the observations made regarding the possibility of scrutinizing the convenience of the contract. The article will also address some systemic issues to better catch a complex topic, already ideologically challenging, such as the fairness of the contract.
