L'ORIGINE STORICA DEL "PREMIERATO" IN ITALIA. QUALI MARGINI PER UNA RIFORMA COSTITUZIONALE?

This contribution stems from the debate on the constitutional reform of the so-called Premiership. Specifically, the prestigious journal Rassegna Parlamentare (Parliamentary Review) launched a forum, attended by four professors, including myself, to highlight the reform's strengths and weaknesses and to propose possible amendments to the draft constitutional reform. I emphasize, in particular, that the so-called Premiership has historical roots in the form of government dating back to the Albertine Statute, from Cavour onward, through Ricasoli, Giolitti, and so on. This is confirmed by the fact that the so-called Salvi Draft, adopted during the work of the D'Alema Bicameral Commission, is now being used as a starting point for resuming the debate on the Premiership. Nonetheless, the usual assembly tendencies are not lacking, which would inevitably push the institutional system toward ungovernability.

Il contributo trae origine dal dibattito sulla riforma costituzionale del c.d. Premierato. In particolare, la prestigiosa Rivista Rassegna Parlamentare ha dato vita ad un Forum, al quale hanno partecipato quattro Professori, compreso il sottoscritto, per evidenziare pregi o difetti della riforma, nonché, per proporre eventuali modifiche al progetto di riforma costituzionale. Il sottoscritto evidenzia, in particolare, che il c.d. Premierato ha un'origine storica nella forma di governo ai tempi dello Statuto Albertino, da Cavour in poi, passando per Ricasoli, Giolitti, ecc... Il che trova conferma nella circostanza che la c.d. Bozza Salvi, adottata in occasione dei lavori della Commissione Bicamerale D'Alema, venga ora assunta a punto di partenza per riprendere il dibattito sul Premierato. Ciononostante, non mancano le solite tendenze assembleari, che inevitabilmente spingerebbero il sistema istituzionale verso l'ingovernabilità.
