Education is a very special sector: in fact, it’s characterized by general interests justifying the intervention of public authorities, but it’s also a field where freedom and purely individual expectations must coexist. Consequently, the regulatory scenario is always in motion and many of the problems that characterize it are destined to remain open, with a legislator constantly called upon to devise new interventions in order to recompose public and private instances. This paper aims to identify the most relevant aspects of the evolution of the legislative and administrative framework of the education system by analyzing the relationship between public and private in the last 150 years: first, with reference to the actors involved in the organization responsible for performance assessments; secondly, with regard to the rules and tools that can be used in the construction of a well-organized system.
