L’inquadramento giuridico e le tutele del direttore di gara dalle discriminazioni alla luce della Riforma dello sport. Un percorso di lettura attraverso il sistema della pallacanestro = The Legal Framework and Protections for Referees Against Discrimination in Light of the Sports Reform: A Reading Path Through the Basketball System

Until the advent of the Italian Sports Reform, studies on the role of the referee were focused generally on analysing the significance of their powers and responsibilities. The explicit inclusion within the so-called Reform of sports represents an opportunity to address the issue of the protection of individual referees, both in terms of the rights recognized to them and with a view to improving the services offered as a category within the sports system. This article reconstructs the framework of the referee before and after Legislative Decree No. 36/2021, highlighting the labour law innovations and the regulations provided by the safeguarding tools outlined in CONI Resolution No. 255/2023 against incidents of abuse, violence, and discrimination based on gender and age stereotypes. The contribution particularly focuses on the world of basketball, as it represents one of the sports with the highest number of practitioners and is still considered as a "male" sport, thus providing a valuable ground for observing the dynamics under analysis. The study compares the new national regulations with various international conventions for the protection of rights, using relevant case law The author identifies the normative and protective actions that sports institutions should adopt to increase the level of protection of the rights of registered members, in order to prevent phenomena of abandonment of the activity linked with gender and age discrimination, which can negatively impact the selection of the best resources available for competitions and consequently their regular conduct.

Fino all’avvento della c.d. Riforma dello sport, gli studi sulla figura del direttore di gara erano tendenzialmente rivolti all’analisi della rilevanza dei suoi poteri e delle sue responsabilità. L’espresso coinvolgimento all’interno della c.d. Riforma dello sport rappresenta l’occasione di affrontare il tema della protezione dei singoli arbitri, sia a fronte dei diritti loro riconosciuti, sia nell’ottica di miglioramento dei servizi offerti come categoria all’interno del sistema sportivo. L’articolo ricostruisce l’inquadramento del direttore di gara prima e dopo il d.lgs. 36/2021, evidenziando le innovazioni giuslavoristiche e le norme previste dagli strumenti di c.d. safeguarding, di cui alla delibera CONI 255/2023 contro episodi di abuso, violenza e discriminazione basati su stereotipi di genere e anagrafici. L’analisi si focalizza in particolare sul mondo della pallacanestro, in quanto è uno degli sport con il numero maggiore di tesserati ed è ancora visto come uno sport “maschile”, rappresentando così un valido terreno di osservazione per le dinamiche oggetto di analisi. Nello studio vengono confrontate le normative nazionali con diverse convenzioni internazionali per la tutela dei diritti, utilizzando la giurisprudenza di riferimento. L’autore giunge ad individuare le azioni normative e di protezione che le istituzioni sportive dovrebbero adottare per aumentare il grado di tutela dei diritti dei tesserati, anche nell’ottica di prevenire fenomeni di abbandono dell’attività legate a discriminazione di genere e anagrafiche che possono di incidere negativamente sulla selezione delle migliori risorse a disposizione delle competizioni e quindi del loro regolare svolgimento.
