The time is out of joint. Ordinare il tempo nelle sentenze della Corte costituzionale

In Italy, the power to control the temporal effects of constitutional judgments – an unavoidable need of modern centralized systems of constitutional justice – finds a serious obstacle in Article 136 of the Constitution. In order to overcome this barrier, the paper proposes a markedly creative reading of it and compares the proposed solution with the alternatives already present today (namely: the postponement to a fixed date of the hearing). In the second part of the essay, assuming that the Constitutional Court has endowed itself with powers to decide the timing of its judgments, the reactions that could be triggered by the legislature, the common courts and the supranational Courts of Rights are analysed.
