The article examines the coup d’état as a constitutional category, highlighting its dual nature as both a rupture of legality and a recurrent instrument of political transition. Using a trans-regional comparative method, it combines conceptual analysis with empirical inquiry. It focuses on Bolivia and Sudan, where coups have evolved from exceptional events into ordinary mechanisms of power change. This shift has undermined constitutional stability and weakened the authority of constitutions. Comparing these cases reveals both shared patterns and differing regional institutional responses, framing the coup as a universal test for contemporary constitutionalism.

Abstract
The article examines the coup d’état as a constitutional category, highlighting its dual nature as both a rupture of legality and a recurrent instrument of political transition. Using a trans-regional comparative method, it combines conceptual analysis with empirical inquiry. It focuses on Bolivia and Sudan, where coups have evolved from exceptional events into ordinary mechanisms of power change. This shift has undermined constitutional stability and weakened the authority of constitutions. Comparing these cases reveals both shared patterns and differing regional institutional responses, framing the coup as a universal test for contemporary constitutionalism.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
