The «immunitas a coercitione in re religiosa» in secular legal systems and in Church. After tracing the evolution of the concept of religious freedom in the Catholic magisterium, always in substantial continuity and without ruptures, the essay dwells upon the marked peculiarities of the protection of the religious freedom within the canonical legal system: where it must be balanced with the need to preserve the depositum fidei and ensure the salus animarum. Subsequently, by illustrating the magisterium of the roman pontiffs following the Second Vatican Council, the study observes how the concern about the safeguard and promotion of the religious freedom, which is gravely violated or threatened still today, remains constant: taking also into account the specific demands postulated by the libertas Ecclesiae.

Il saggio, dopo aver segnalato l’evoluzione del concetto di libertà religiosa nel magistero cattolico, pur sempre nella sostanziale continuità e senza cesure, indugia sulle marcate peculiarità della tutela della libertà religiosa all’interno dell’ordinamento canonico: ove essa va contemperata con la necessità di salvaguardare il depositum fidei e di assicurare la salus animarum. Illustrando poi il magistero dei romani pontefici successivi al Concilio Vaticano II, si osserva come permanga costante la preoccupazione affinché la libertà religiosa, ancora oggi gravemente vulnerata o minacciata, sia salvaguardata e promossa: tenendo altresì conto delle esigenze specifiche postulate dalla libertas Ecclesiae.
