'All the President's Chaplains'. Palatine Clergy, Military Ordinariate, Vicariate of Rome. - The spiritual assistance provided to specific categories of subjects is a theme that cannot be ignored by scholars who study the interactions between religious factors and law. However, it is rarely addressed in relation to the figure of the Head of State and those who constitute the apparatus at his service, with such a perspective being considered – not without good reasons – relegated to the past. Yet, some interpretations place the palatine clergy that was formally suppressed only after the concordat revision of the 1980s in continuity with the current military ordinariate in Italy, viewing the entire presidential administration previously entrusted to the pastoral care of the former and today of the latter. This is an interpretation, however, that cannot but raise doubts. The essay therefore aims to shed light on the issue, placing itself at the crossroads between the remote and recent history of our country, as well as between the dynamics of Canon Law and those that mark the evolution of relations between Church and State.
Quello dell'assistenza spirituale prestata a specifiche categorie di soggetti è un tema che non può essere ignorato dai cultori delle interazioni tra fattore religioso e diritto. Raramente, però, si pensa ad esso in relazione alla figura del Capo dello Stato e di coloro che compongono l'apparato posto al suo servizio, ritenendo una simile prospettiva – non senza buone ragioni – relegata al passato. Eppure, alcune letture pongono in continuità quel clero palatino formalmente soppresso solo dopo la revisione concordataria degli anni Ottanta con l'attuale ordinariato militare in Italia, ritenendo l'intera amministrazione presidenziale affidata alla cura pastorale ieri dell'uno e oggi dell'altro. Si tratta di un'interpretazione, però, che non può che suscitare perplessità. Il presente contributo si propone perciò di gettare luce sulla questione, ponendosi al crocevia tra storia remota e recente del nostro Paese, nonché tra le dinamiche proprie del diritto canonico e quelle che contrassegnano l'evoluzione dei rapporti tra Chiesa e Stato.
